APPLICABILITY OF STATUTORY FINANCIAL DISCLOSURE LAW TO STATE EMPLOYEE RECEIVING IN EXCESS OF $250 FOR CONSULTING SERVICES

QUESTION:

 

Am I, a full-time state employee who will have received in excess of $250 this year for consultations with a federal agency, a "specified employee" for purposes of filing financial disclosure?

 

Your question is answered in the affirmative.

 

Enclosed, please find a copy of a previous advisory opinion, CEO 77-85, the rationale of which is equally applicable to your situation. Accordingly, having received over $250 for consultations during the year 1977, you will be required to file disclosure for the 1977 disclosure period prior to noon of July 15, 1978, with the Secretary of State.

In addition, we are enclosing copies of CEO's 75-141 and 75-146, although the law has changed somewhat since they were issued, in order to give you some guidance as to the meaning of the term "consultation."
